Open space on LI in jeopardy
(02/09/10) MIDDLE ISLAND - To find a 100-acre piece of land like the one Gene Smith owns in Middle Island is nearly impossible, which is why he is frustrated it is falling into disuse.
Despite paying $30,000 in taxes on the land per year, Smith says he can’t do anything with it.
The land is Pine Barrens land and under the Pine Barrens Act of 1993, only New York State can buy it. However, money set aside for purchasing such land has been spent elsewhere.
Richard Amper, of the Pine Barrens Society, says if landowners can’t be compensated, the entire Pine Barrens Act could be declared unconstitutional.
Smith says he intends to sue because he can’t afford to pay taxes on land he doesn’t use.
Looks like if the Pine Barrens Comm can't come up with the dollars the landowner can sell the land to developers.

Depending on what the current zoning is will prolly determine it's value. And if it is in the core protection area, well I don't think I will live long enough to see that property in play. just my $0.02
Unless we want to pull a Brutton Smith and run a bulldozer down the middle followed by cement trucks and a bank check for the property. I'm with Art. On the list makes it useless. you see Long Island need that space for low income housing for squirrels, a place for endangered spotted newts to fart and small eared owls to hear those farts seeing is how they have small ears. In that arena you are dealing with closed minds.
I feel bad for the owner who will probably lose that property to default for non payment of taxes, which is probably Ampers humain way of screwing people to get what he feels is good for us all.

Unfortunately, there is a reason nobody wants to buy as stated in the vidio, it is pine barens, you can't do anything to the property. Who would invest money in something they can't use.

This poor bastards story has been told before, he bought it in the 80's as a retirement property, then told he cant build on it, neither can any one else, EVER!
I have friend going thru a similiar deal, Bought a house in Hewlett, wanted to add on to the back deck, WHOA,, the historical committeee shows up, gets the house declared, he's fucked silly! cant even pave his gravel driveway now.

You are 100% correct Bruton Smith would not waste his time here.
I'm sure BB Bill has been to Zmax Dragstrip as I have also.
Go there and you'll understand why. The town even named the street after him.
The point of the story the way I see it is like this:
1) The man purchased the property in 1984 with a vision of developing it. He could have developed it in 1984 because the Pine Barrens Comm did not exist until 1993. He had nine years to develop the land. Look where NY National used to be. It was located in the Pine Barrens Region also. They bulldozed the trees when they developed the track. Nobody said boo in 1964 did they?
2) The Pine Barrens Comm is formed in 1993 and his land like 100's of other parcel owners becomes part of the Pine Barrens Region. Laws are introduced so land owners when they sell can only sell the land to them. They can't develop it either.
3) Fast forward to 2010. The man now wants to sell the property. He approaches the PPC and they say they have no money because NYS used the set aside funds to balance the State budget. NYS hung the PPC out to dry. Look at the video again and listen to Amper. He says it himself in a round about way. The PPC is in a difficult position. The NYS budget is in bad shape. They are considering closing 10 NYS parks on LI over the summer. The State does not even have money to operate their park system. Look at the Newsday article today about the NYS parks. Patterson keep up the great job!
4) The property owner is now going to sue the PBC in Federal Court citing that the PBC is unconstitutional. If the Federal Court finds this unconstitutional it will be a major blow to the PPC. The ruling sets up a chain reaction for all the 100's of property owners in the same position. They will all jump on the band wagon to get rid of land that is useless to them. The property owners can then sell their property to developers because the PPC is found to be unconstitutional. The PBC will go down the tubes.
It will be interesting to see how this plays out.
Relisten to the video if you get a chance. Listen to Amper's voice. He is scared and his voice reflects it.

If you watched the video, he is taking it to court because if the state cannot compensate him for the land they cannot keep it as pine barrens.

A while back Don posted about a piece of property along side the Long Island rr tracks in Farmingdale for an 1/8 mile track. This land was surplus state property. Have we ever looked into the list of surplus state owned property and petitioned the govt. in control of it if they would be interested in parting with it at a surplus price. The govt. is in financial trouble and could use the cash. Letting them know up front the purpose the property is being purchased for would for a builder cut out a lot of the costs as the property is being sold by govt for that purpose. They know what they have and where it might work plus money is tight so while the irons hot.
A savings in the price of a property along with much of the usual govt fees requirements ect. might intice a builder to invest as cost recovery would be greatly reduced. Just a thought from the past we didn't pursue.
On my way to get blood work I noticed a 36 acre lot commercial zoned in Medford on Horseblock Rd. just west of the LIRR overpass for sale.It's got a road opening cut into it with mansonary walls at the entrance. Didn't get a number.Too small? Not far off the Expressway and an easy run to Sunrise.It's a few miles west of the Yapank site.

Believe me the money is there...... more than you can imagine. The search is on for the property. The property in Calverton would already be up and running, except for the minor problem, the realtor would not commit to the property being used as a race track. They would be happy to sell and dump that issue in the buyers lap. The owner is the town of Riverhead. The main obstacle has been removed and the process is gearing up again through meetings with the proper people.

Every time this subject was brought up. Marty said and i quote " don't waste ur time, it'll never happen"
A lot of ideas were never looked into any farther because "our fearless leader" always shot down anyone elses idea because "we were clueless" and "had no idea what he was doing n what was going on behind the scenes" so he didnt want any of us going on our own and "fucking up deals he had already in the works" ............ or something like that.

Why is it he can't lose the property if he doesn't pay taxes. There already is something going on that legally can't be. The County or State i'm not sure which is legally supposed to buy the property at fair market value, but they can't because there is no money.....

Steve I know you and Marty don't see eye to eye but do you think posting it for all to see is a good idea. Unity is what works. Marty is probably the only one really doing anything and has people he 's working with he's in the trenches. He posts on the LIMA site things he feels he can at the point he is in, with the negotations he is working on.He started LIMA meetings again for members to go to and give their input. The people Marty is working with have a vision for what they want to do. They require certain parameters for their successful business venture. This is to owner operators a business to us a passion. All that being said I put things out there just in case someone out there is looking as Bill has said,there is money out there and maybe it's not the people Marty is working with. Any one of us is allowed to do what ever we want. If someone else can get it done so be it but other than Marty nobody else is stepping up to the plate. Go on the LIMA board or to the next meeting and talk with all those that go.Put your ideas out there it's what it's all about. But do it in a way that's positive.

Technically that might work. For a $30,000 bill would have to be more then $1 though. If you did that the judge would see that as you being a dick and probably over rule you. But also, say he sent $100.00 a month. Technically they couldnt take hios property but.............. The money he owes would be acruing interest the whole time, so when he dies they would get the property any way.

I own property in the "compatible gowth area" and was given credits for some of it. I have a feeling he waited to long to unload the property. I you show "intent" to pay they can't touch you.
