Armed with maps and color renderings, Suffolk County Executive Steve Levy earlier this month spent an hour detailing for regional planners his $400 million mega-project in Yaphank dubbed "Legacy Village."
Using a laser highlighter, Levy pointed to indoor and outdoor arenas, a downtown center that includes a hotel, restaurants and shops with 72 rental apartments above the retail sites. He also laid out plans for 1,000 affordable units, including 215 at market price with accessory apartments, scenic walkways, a day care center and ballfields. To top it off, he cited a 99-acre high-tech industrial park, powered by the sun.
But when Levy's planning department filed its Environmental Assessment Form last week the documents asserted there are "no specific or definitive plans" for developing the property.
That apparent contradiction and how to tackle it goes before Suffolk's eight-member Council of Environmental Quality this week. At issue is whether an environmental-impact statement is needed before the legislature can declare the 255 county-owned acres surplus and authorize their sale to a developer. The council, which meets Wednesday at Timber Point County Park in Great River, makes a recommendation on which the county legislature must then vote.
It will be the first battleground in what's expected to be a protracted war over the project. Local civic and environmental groups are concerned about the impact on the Carmans River watershed and the impact on the still rural community. School officials also fear the project will generate too many extra students.
Unions and business strongly back Levy's project for the jobs it will create and the affordable housing it will supply for the young who now have nowhere to live.
Levy has maintained the pending resolution should be looked on simply as a sale of surplus land and any extensive environmental review should be left to the town, which has control over zoning.
"It would be wasteful to do two full-fledged environmental impact statements," Levy said. "It makes sense for the town to do it." He said local foes want a county review so the project suffers "a slow death."
However, Richard Amper, executive director of the Long Island Pine Barrens Society, said Levy has an "edifice complex" and simply wants to disregard potential impacts the project might have. "If the county goes ahead, we will tie them up in court for three years and win," said the environmentalist who often clashes with Levy.
The county executive, however, wants immediate action from the council. He even sought to move back Monday's meeting of the legislature's energy and environment committee to Thursday so the sale resolution can move to the full legislature at next week's meeting, the last of the year.
Presiding Officer William Lindsay (D-Holbrook) would not change the meeting date, but said a special meeting can be called, if needed.
Legislative officials say Levy has another motive - a financial one. Once the county closes on the property, it will get its first $11 million from the developer for the industrial tract at the southern end of the project, which is already zoned industrial and needs no changes. That money could help close Suffolk's continuing budget gap next year.
Some experts say Levy could have avoided the entire dilemma if he had declared the land surplus first and then gone through the process to solicit developers and their plans.
"It's a very difficult legal mess," said Michael Kaufman, the council's vice chairman. "You can't just simply call it a sale of surplus land when there's a development plan attached to it . . . it's a procedural nightmare."

Funny, we spend and extra 1/4 of a percent sales tax to preserve "open space", yet this open space doesn't count. I knew I shouldn't have napped during political science. Then again after taking it for the third time (the charm), I figured I would pass without any effort.....

A lot of fun can be had at that meeting coming up, if everyone didn't quit and let him win.... we could show true dictatorship is alive and well on long island... in a supposedly true democracy....
Oh well..... how sad it is, but i gotta hand it to dick....as much as he makes me nuts, he'll get it done...with a far far smaller group

No I believe I live in section 9.The article did point out accessory apartments on some units.I'm sure that is for the families with more than twenty relatives living with them,like my old neighborhood.

Yes that would be Dick Amper of the Pine Barrrens thingie. He has all but said he will just tie it up in legal challenges.
